The Dark Side of the EULA

I’ve seen a lot of articles lately about EULAs (End User License Agreements) and how some contain some pretty strange requirements. Here’s just a few..

Google: “You may not use … Google’s products, software, services and web sites … and may not accept the Terms if … you are not of legal age to form a binding contract with Google.” In the United States, the legal age to form a binding contract is 18. Therefore, if you are underĀ 18, you cannot use Google.

Apple Safari: “This License allows you to install and use one copy of the Apple software on a single Apple-labeled computer at a time.” If you downloaded the Safari browser on that Windows machine, whether by choice, or by “recommendation” via Apple Update when you have iTunes installed, it was illegal! [Note: I believe this has been fixed, but this was in place for over a year.]

Adobe Photoshop Express:Adobe does not claim ownership of Your Content. However, with respect to Your Content that you submit or make available for inclusion on publicly accessible areas of the Services, you grant Adobe a worldwide, royalty-free, nonexclusive, perpetual, irrevocable, and fully sublicensable license to use, distribute, derive revenue or other remuneration from, reproduce, modify, adapt, publish, translate, publicly perform and publicly display such Content (in whole or in part) and to incorporate such Content into other Materials or works in any format or medium now known or later developed.” So the next time you see that picture of yours on the internet somewhere, Adobe probably sold it off for an undisclosed amount of cash and kept the dough to themselves. [Note: Adobe has been told of this, but I don't know if it's been fixed]
